1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the website, tools, and services operated by Matt Ratliff under the FunnelTechie brand (“FunnelTechie,” “we,” “us,” or “our”). By accessing our website, purchasing a service, or using any of our tools, you agree to be bound by these Terms.

If you do not agree to these Terms, you must immediately discontinue use of our website and services. We reserve the right to update these Terms at any time. Continued use of our services following any changes constitutes your acceptance of the revised Terms.

2. Services

FunnelTechie offers the following services and products:

Email Deliverability Consulting & Audits

• The Holy Grail Email Audit — A comprehensive one-time audit and optimization of your email sending infrastructure, including DNS authentication, blacklist remediation, and open rate optimization.
• Premium Done-For-You Email Service — Ongoing monthly management of your email reputation, monitoring, and optimization. Requires a minimum 3-month commitment. Not available for cold email outreach operations.
• Email Service Provider Migration — Full-service migration from one email sending platform to another, including dedicated IP setup, warmup strategy, and authentication configuration.
• 1-on-1 Email Strategy Session — A live Zoom consultation where Matt diagnoses and resolves your specific email deliverability issues in real time. Sessions are recorded and provided to the client.

Digital Tools

FunnelTechie develops and operates the following tools, available under their respective terms:

• Domain Auth Checker (checker.funneltechie.com) — Free diagnostic tool for SPF, DKIM, DMARC, and MX record verification
• InboxIQ (myinboxiq.com) — Inbox placement and deliverability intelligence platform
• Score My Email (scoremy.email) — Email deliverability scoring and diagnostic tool
• Mailgun Flow (mailgunflow.com) — Mailgun management and reputation monitoring tool
• PromotabFix (promotabfix.com) — Gmail Promotions tab diagnostic and remediation tool
• Inbox Ready Newsletter (inboxready.funneltechie.com) — Weekly email deliverability newsletter

Tool availability, features, and pricing are subject to change. Free tools are provided “as-is” without warranty of any kind.

3. Payment & Refunds

All prices are listed in US Dollars (USD). Payment is due at the time of purchase unless otherwise agreed in writing.

One-Time Services

One-time service fees (audits, migrations, strategy sessions) are non-refundable once work has commenced. If you cancel before work begins, a full refund will be issued within 5 business days.

Subscription Services

The Premium Done-For-You Email Service requires a minimum 3-month commitment. You may cancel at any time after the initial 3-month period with 30 days’ written notice. No refunds are issued for partial months already billed. Cancellation does not relieve you of payment obligations for the minimum term.

Disputes

If you believe you have been charged in error, you must contact us within 30 days of the charge. We will work in good faith to resolve any billing disputes. Initiating a chargeback without first contacting us may result in suspension of your access to our services.

4. Client Responsibilities

To enable us to deliver our services effectively, you agree to:

• Provide accurate and complete information about your email infrastructure, sending platforms, and business operations
• Grant necessary access to DNS records, email service provider accounts, and other systems as required for the engagement
• Implement recommendations in a timely manner and communicate any obstacles
• Maintain compliance with all applicable email marketing laws and regulations, including CAN-SPAM, CASL, and GDPR
• Ensure your email lists consist of opted-in subscribers who have given valid consent

Sending Behavior & List Hygiene

You are solely responsible for the content, frequency, targeting, and volume of emails sent from your domain and sending infrastructure. FunnelTechie’s work establishes and optimizes your technical email foundation; it does not protect against, authorize, or mitigate damage caused by poor sending practices.

The following client behaviors are outside the scope of FunnelTechie’s services and may directly undermine deliverability outcomes, regardless of the technical work performed:

• Sending to purchased, rented, scraped, or otherwise improperly sourced email lists
• Sending to unengaged subscribers without proper list hygiene and suppression practices
• Sending email content that triggers spam filters, including misleading subject lines, excessive links, or prohibited content
• Sending at volumes or frequencies inconsistent with your established sender reputation
• Ignoring unsubscribe requests or failing to honor opt-out mechanisms
• Engaging in cold email outreach using domains or infrastructure managed under a FunnelTechie engagement

High complaint rates, spam trap hits, blacklistings, or inbox provider filtering resulting from client sending practices are not grounds for refund, dispute, or service credit. FunnelTechie is not responsible for deliverability outcomes caused by client non-compliance with sending best practices.

Ongoing Nature of Email Deliverability

Email deliverability is not a one-time fix. Inbox provider algorithms, sender reputation scores, blacklist criteria, and authentication standards evolve continuously. Results achieved during a FunnelTechie engagement reflect the state of your infrastructure and reputation at that point in time.

You acknowledge and agree that:

• Deliverability performance may degrade after the conclusion of a service engagement if best practices are not actively maintained
• Ongoing monitoring, list hygiene, and reputation management are required to sustain inbox placement over time
• FunnelTechie is not responsible for deliverability decline that occurs following the end of an active service period
• A one-time audit or migration does not substitute for ongoing deliverability management

5. Disclaimer of Warranties

Our services, tools, and website are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that:

• Our services will achieve specific deliverability rates, open rates, or inbox placement percentages
• Our tools will be error-free, uninterrupted, or free of security vulnerabilities
• Results obtained from our services will meet your specific business objectives
• Any advice or recommendations will be suitable for your particular circumstances

Email deliverability is influenced by many factors outside our control, including mailbox provider algorithm changes, sender reputation history, list quality, and content. While we apply industry best practices and deep technical expertise, we cannot guarantee specific outcomes.

6. Limitation of Liability

To the maximum extent permitted by applicable law, FunnelTechie and Matt Ratliff shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of revenue, profits, or business opportunities
• Loss of data or email deliverability performance
• Costs of substitute services
• Damages resulting from unauthorized access to your accounts or systems

In no event shall our total liability to you for all claims arising from or related to our services exceed the total fees paid by you to FunnelTechie in the 90 days preceding the claim.

7. Intellectual Property

All content on the FunnelTechie website and tools — including text, graphics, logos, software, tool interfaces, and methodologies — is the exclusive property of Matt Ratliff and FunnelTechie, protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any of our content without prior written permission. Limited personal, non-commercial use is permitted provided you retain all copyright and proprietary notices.

Any feedback, suggestions, or ideas you provide to us may be used by FunnelTechie without obligation or compensation to you.

8. Confidentiality

In the course of providing services, we may have access to confidential information about your business, including customer data, email lists, revenue figures, and technical infrastructure. We treat all such information as strictly confidential and will not disclose it to third parties except as required to deliver the services or as required by law.

Similarly, any proprietary methodologies, tools, pricing, or processes we share with you during an engagement are confidential and may not be disclosed to third parties or used to compete with FunnelTechie.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against FunnelTechie.

10. Termination

We reserve the right to terminate or suspend your access to our services at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or used our services in a manner that harms FunnelTechie or third parties.

Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimer of warranties, limitation of liability, and governing law) shall survive.
